DESCRIPTION: The ADR committee provides alternative means for members representing motor carriers, brokers, logistics providers and others in the transportation space to mediate and arbitrate their disputes with qualified and experienced transportation law counsel. We have an extensive list of members, including members that are certified arbitrators, that are ready to serve. If you have not already considered joining the list of mediators and arbitrators, we encourage you to apply.
In addition to serving as an arbitrator or mediator, the ADR committee provides a resource for our members and their clients. As many of you know, arbitration can be an effective and often faster way to resolve disputes than litigation. Additionally, arbitration allows for greater control of the proceedings. Parties can select an arbitrator whose expertise aligns with the subject matter of the dispute, and the ADR committee allows parties to specifically elect this form in their contracts. Members should encourage their clients to see what forum options they have selected for dispute resolution and consider adding the Transportation Lawyers Association as an effective way to resolve their disputes.
The ADR committee is also pleased to provide members of the Transportation Lawyers Association continuing legal education opportunities to become certified arbitrators and gain experience to build their own mediation and arbitration practice.

DESCRIPTION: The Antitrust and Unfair Trade Practices Committee provides both a forum for practitioners to discuss current legal issues and to circulate information to the entire TLA membership. In addition to traditional antitrust and unfair competition law issues, unfair trade practices law encompasses a wide array of legal issues, ranging from consumer protection to labor issues to intellectual property disputes to computer fraud and trade secret theft. It involves all areas of the logistics and transportation industries, including air, ocean, motor, rail, bus, pipeline, third party intermediaries, household goods carriers, public transportation, ride-share companies, and e-commerce and final mile delivery companies. In addition to federal, state, and occasional foreign statutory developments the Committee also follows litigation and regulatory actions. A few of the federal agencies that we follow include the DOT; FAA; FMC; FMCSA; STB; DOJ; FTC; CBP; DOC; and USPTO.
The committee regularly prepares and presents topics for the legal education programs at the TLA Annual Conference; the Transportation Law Institute; and the Chicago Regional Conference. In addition, we frequently coordinate and publish written articles prepared by committee members for publication in The Transportation Lawyer, including an annual round-up of litigation, legislation, and other matters. The Committee also has online meetings where we engage in “hot topic” discussions on current issues. Recent topics of discussion have included airline merger developments; new regulations on practices related to detention and demurrage and unreasonable refusals to deal; the FTC non-compete rule; antitrust litigation involving online e-commerce fulfillment services; and legal issues related to working with competitors in joint ventures, trade associations, and developing industry standards such as blockchain and smart contract rules. The Committee provides an opportunity for TLA members to keep abreast of new legal developments and to share their knowledge and experience regarding competition and unfair trade practices law with their fellow TLA members.

DESCRIPTION: The mission of TLA’s Casualty Committee is to share cutting-edge information, strategies and best practices for the effective defense of accident litigation filed against the transportation industry. Our committee partners closely with other TLA committees to broaden the reach and impact of our mission and to foster member engagement. While historically motor carrier litigation has been emphasized, the committee also covers accident litigation involving other modes of transportation. The primary areas of focus include trial tactics (including those designed to counter the Reptile strategy), litigation strategy, insurance coverage, and accident investigation. DESCRIPTION: A central purpose of TLA’s Committee on Federal Regulations is to furnish all TLA members with monthly updates about federal regulatory developments affecting casualty litigation, cargo claims, pricing disputes, administrative penalty defenses, licensing procedures and transactional matters. Committee members also are encouraged to present webinars, write TTL articles, participate in “live” conference panels and attend Committee meetings held at most TLA conferences.
With political and policy changes on the horizon, the Committee will emphasize the procedural nuts and bolts of advocating (or opposing) changes in the substantive rules and licensing processes of federal administrative agencies regulating motor, rail, maritime and air transportation. In addressing these topics, the Committee sincerely requests input from TLA members on their major concerns, be they supply-chain fraud, safety fitness requirements, registration reform, broker “transparency,” crash “preventability” or how to distinguish “guidance” from binding rules in any or all of these areas.
Our overriding goal is to help TLA members answer frequently asked questions such as this: “What do truck lawyers (or lawyers advising any mode) need to know about the Administrative Procedure Act, the Paperwork Reduction Act and the gauntlet of other federal statutes on rulemaking, licensing, federal preemption or other phases of administrative law?” And this: “What do present-day litigators and transactional lawyers in those fields need to know about traditional commerce rules such as constructive broker trusts and the recourse rights of carriers in freight charge disputes?” We look forward to hearing from you!
